Elder Law Matters

Elder law is a large field of law that protects the aging population. We specifically tend to the issues of potential and present incapacity.

No matter your age, there are practical considerations to take into account. Whether you’re planning for the potential of losing your own capacity or  concerned about a loved one, we’ll lead you through the legal processes to help you get the assistance you need.

Incapacity Documents

Whether you’re a young person heading off to college or an elder with an early-stage dementia diagnosis, everyone should consider pre-emptively preparing for a life event that causes incapacity. We advise our clients through the execution of a durable Power of Attorney and Advance Health Care Directive before help is even needed. We help you take control of deciding what you’d want and who you want to support you so that a court doesn’t have to. We’ll lead you through the documents to be sure that they reflect your priorities and leave you with a feeling of relief that the right person is enlisted to help before you ever need it.

Guardianships & Conservatorships

Sometimes a loved one loses their ability to make sound financial and personal decisions. If there isn’t a power of attorney or advance health care document in place, then the Court will consider a petition to name a person or organization as a Guardian or Conservator. Perhaps you have a guardianship or conservatorship in place in another state and want to transfer those to New Mexico. In any case, we will help you understand what needs to be done and lead you through the legal processes with integrity, consistency, and respect.

Contacting us through our website does not form an attorney client relationship. An attorney client relationship is only formed if we first pass you through a conflicts check and then enter a written engagement agreement with you.
